ORR disagreement resolved

ASLEF has reached a satisfactory outcome to the disagreement with the ORR over the prosecution of an ASLEF member following an operational incident.

After correspondence with the ORR, ASLEF has received the following reassurance:

“If a driver performs their duties consistent with their training, competence and written procedures,or as otherwise instructed by a person with the appropriate authority, even if those instructions or written procedures were not robust, we would not take action against the driver”.

After meeting with industry stakeholders, including the RSSB, a process will be put in place to revise the rule book in order to establish a clearer and more safety based process when there is a communication failure.

The general secretary’s advice to members to run at 20mph in the event of a communications failure has therefore been rescinded.
